Orange County District Court
The following cases were heard before Judge Robert P. Gerety Jr. on Oct. 2, and all defendants were released on conditions unless otherwise noted.
On Sept. 30, Mark Mattiace, 35, of East Corinth failed to appear for an arraignment for vehicle operation with suspended license on July 30.
Jonathan Ayers, 25, of Randolph pleaded innocent to seven counts of bad checks: two on Feb. 27, one on Feb. 28, one on April 23, two on April 24, and one on Aug. 28. Ayers was held at Southern State Correctional Facility in Springfield on $1000 bail; conditions include orders not to harass or have contact with his alleged victims nor enter onto the premises of Bob’s Beverage or Home Café in Randolph.
Cynthia LaPlante, 51, of Randolph pleaded innocent to two counts of violation of conditions of release on Oct. 1. LaPlante was released on $1000 bail.
Travon E. Groves, 24, of Randolph pleaded innocent to disorderly conduct (noise) on July 18.
Heather Whipple, 20, of Waterbury Center pleaded innocent to disturbing the peace by phone (threatening harm) on Aug. 1 and false alarm (fire-emergency) on Aug. 31. Whipple was ordered not to harass or have contact with her alleged victim nor enter onto a certain property on Rte. 14 in Williamstown.
Rena M. Gomez, 48, of Randolph pleaded innocent to violation of conditions of release on Aug. 13.
Kyle Kendall, 21, homeless, pleaded innocent to driving under the influence (DUI) and resisting arrest on Sept. 13.
Edwin L. Farnham, 27, of Williamstown pleaded innocent to vehicle operation with suspended license on Aug. 12.
Luke Hafford, 19, of West Fairlee pleaded innocent to vehicle operation with reckless or gross negligence and a felony of negligent operation (eluding law enforcement officer) on Oct. 2. Hafford was held at Chelsea L=lockup on $750 bail.
Daniel T. Guarino, 26, of Brattleboro admitted violation of probation as filed on Aug. 15. The probation stems from convictions for: DUI, resisting arrest, and simple assault on a law enforcement officer, all on May 17, 2012. Guarino’s sentence was suspended except 20 days and his probation warrant was modified on VOP to expire Jan. 16, 2015.
Kevin A. Hill, 40, of Bradford admitted violation of probations, second offense, as filed on Sept. 16. A charge of violation of conditions of release on Sept. 12 was dismissed by the state. The arresting agency was VSP (Bradford). Hill’s sentences were amended to serve one to three years, with credit for time served since Aug. 26, to start on Oct. 2 at Southern State Correctional Facility in Springfield.
A sentencing hearing was held for Dean A. Kennedy, 51, of Tunbridge. Kennedy was convicted on two counts of felony sexual assault on a minor under 16 in Jan. 1997; he admitted a second violation of probation as filed on Jan. 2, 2013. Kennedy’s sentence will be suspended except seven months, extensive conditions include complete sex offender therapy; no contact with his victim without approval; no unsupervised contact with females under 16; responsibility for paying for future therapy costs for his victim; and more than a dozen other codtions.
Jason A. Brickner, 38, of Tunbridge pleaded guilty to careless or negligent vehicle operation on April 12. A charge of DUI was dismissed by the state. He was sentenced to pay $601 in fines and surcharges.
Kody R. Fitzgerald, 21, of Montpelier pleaded guilty to petit larceny ($900 or less) on Sept. 1. He was sentenced to serve three to 12 months to start Oct. 9, concurrent to charges faced in Windsor County.
David R. Stearns Jr., 44, of Bradford pleaded guilty to disorderly conduct (fight) on March 22. He was sentenced to pay $371 in fines and surcharges.
Susan Leary, 49, of Rochester pleaded guilty to unlawful mischief ($250 or less) on July 26. Leary was sentenced to serve one to two days to start on Oct. 15 in a Furlough Community Restitution Program up to 8 hours each day.
Denise Brissette, 44, of Thetford Center pleaded guilty to vehicle operation with suspended license on Aug. 16. She was sentenced to $542 in fines and surcharges.
Randy Oakley, 39, of East Corinth pleaded guilty to careless or negligent driving on Sept. 17, amended from DUI. Oakley was sentenced to pay $657 in fines and surcharges.
Jonathan Vielleux, 30, of West Newbury pleaded guilty to vehicle operation with suspended license on Sept. 4. A charge of violation of conditions of release was dismissed by the state. Vielleux was sentenced to pay $542 in fines and surcharges.
