Orange County District Court

The following cases were heard Feb. 8 before Judge Harold E. Eaton Jr., and all defendants were released on conditions unless otherwise noted.

Arraignments

Kyle Earls, 21, of Williamstown pleaded innocent to simple assault on Dec.10. He was ordered not to harass or have contact with his alleged victim.

Ubonwan Bean, 36, of Randolph Center pleaded innocent to domesĀ­tic assault on Nov. 30. Bean was ordered not to harass the alleged victim.

Gene A. Welch Jr., 29, of East Corinth pleaded innocent to driving under the influence (DUI) and possession of less than two ounces of marijuana on Jan. 21.

Michael Clancy, 23, of Newbury pleaded innocent to DUI on Jan. 19.

James Spaulding, 18, of South Royalton pleaded innocent to DUI on Jan. 21.

Sentencings

Joshua McCarthy, 29, of South Royalton, pleaded guilty to two counts of sale or delivery of less than one half an ounce of marijuana, on Nov. 15, 2010 and Nov. 17, 2010. McCarthy was sentenced to serve 50 to 60 days to start on Feb. 15 in a Furlough Community Restitution Program, and to pay $932 in fines and surcharges.

Todd Grabek, 22, of Lyndonville admitted violation of probation, second offense, as filed on Feb. 7. The probation stems from a felony charge of possession of one pound or more of marijuana on March 18, 2010. His probation warrant was modified; probation expires July 19, 2013 and conditions include an order not to purchase, possess or consume alcoholic beverages, and electronic monitoring at the direction of probation officer.

Ivan Deutsch, 20, of Randolph pleaded guilty to three counts of unlawful trespass at a building on Sept. 10; all were amended from felony counts of burglary. Deutsch also pleaded guilty to attempted petety larceny (less than $900) on Sept. 11. This charge was amended from a felony of attempted burglary, and a second charge of unlawful mischief was dismissed by the state. Deutsch also pleaded guilty to petty larceny on Sept. 24; a second charge, unlawful mischief, was dismissed by the state. Deutsch was sentenced to serve four months to two years to start on Feb. 8 at the Southern State Correctional Facility in Springfield, with credit for 140 days served since Sept. 22.

Kyle Ashford, 22, of Topsham had his probation warrant modified for violation of probation, second offense, as filed on Jan. 4. The probation stemmed from a felony charge of sexual assault, no consent, on Jan. 22, 2010. Ashford’s sentence was suspended except 60 days; conditions include sex offender treatment and possible home confinement.

David Dunn, 25, of Brattleboro pleaded guilty to a felony of possession of two grams or more of heroin on Feb. 2. Dunn was sentenced to serve three to five years, all suspended except six months, and placed on probation until Feb. 8, 2016 under conditions including: substance abuse counseling and treatment, urinalysis, curfew, and restriction of associates, as directed by probation officer. Dunn was held at Southern State Correctional Center in Springfield.

Dana C. Kendrick, 48, of Orange pleaded guilty to DUI on Jan. 19. Kendrick was sentenced to serve six to 12 months all suspended, fined $301, and placed on probation under conditions.
