18-Year-Old Relieved
Of Loaded Handgun

An 18-year-old Randolph male arrested March 31 for marijuana possession had a loaded .45-caliber handgun tucked into his waistband when he was stopped by Randolph police.

Devin Bagalio was cited to court on a misdemeanor marijuana charge and relieved of his two guns, according to RPD Chief Jim Krakowiecki.

RPD Officer Chris Alting was on a special DUI patrol, funded by the Governor’s Highway Safety Program, when he pulled over Bagalio’s Jeep Cherokee at 9:45 p.m. for no license plate light.

During a stop for defective equipment at the Cumberland Farms parking lot, Officer Alting detected an odor of intoxicants and asked Bagalio to exit the car.

Bagalio advised the officer he had a gun in his waistband and turned it over, and in a subsequent "pat down for officer safety," Alting found a glass pipe and two baggies, all containing "suspected marijuana."

Bagalio was asked to perform field sobriety exercises and was given a preliminary breath test. The result, .013% was under the .08% legal limit for all drivers, and also under the .02% limit for drivers under 21.

However, Bagalio was taken into custody for suspected marijuana possession. At that time he advised Alting that he had a second firearm, a .9-mm handgun, in his vehicle. Alting retrieved that gun, and processed Bagalio on the possession charge at RPD. The substance in the bag later field-tested positive for marijuana, police said.

Bagalio was cited to Orange District Court. Since it is a federal violation to be arrested while carrying both drugs and a firemen, the federal Alcohol, Tobacco, and Firearms agency has been contacted.

The case remains under investigation.

Chief K noted this week that the .45-caliber handgun Bagalio was carrying is a "big gun, that makes a hole the size of a pen going in, and about the size of a garage door coming out." The gun, frequently used in World War II, is of a slightly larger caliber than the 40-caliber gun carried by RPD officers.
